Terms of Service

These Terms of Service ("Terms") govern your use of POV Machine, operated by WMT Inc. ("we," "us," or "our"). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

POV Machine is designed for use in Washington State only. You must be a licensed property manager or authorized representative of a property management company to use this service. One account per company.

You agree not to:

• Use the service to generate notices outside of Washington State
• Upload documents you do not have authorization to process
• Attempt to reverse-engineer, scrape, or resell the service
• Use the service for any unlawful purpose

Usage is billed at $0.25 per approved notice. Invoices are generated on the 1st of each month for the prior month's approved notices, with one line item per property. Invoices are charged automatically to the payment method on file.

If a payment fails, your account status will be set to past due. We will attempt to notify you by email. Access to notice generation may be suspended until the outstanding balance is resolved.

All fees are in US dollars and are non-refundable except where required by law or at our sole discretion.

You retain ownership of all data you upload to POV Machine, including property records and AppFolio reports. By uploading content, you grant us a limited license to process it for the purpose of generating your notices and maintaining your account records.

You are responsible for ensuring you have authorization to upload and process any tenant data. Do not upload documents containing sensitive personal information beyond what is necessary to generate a notice.

While we work to extract data from AppFolio reports accurately, automated parsing is not infallible. You must review every generated notice before approving or serving it. Specifically, you are responsible for verifying:

• The tenant name, unit, and property address are correct
• The balance owed is accurate as of the notice date
• The notice period and cure deadline comply with your jurisdiction's rules
• Any partial payments or credits have been accounted for

We are not liable for errors in notices that you have approved and served.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED NOTICES WILL BE LEGALLY SUFFICIENT IN YOUR JURISDICTION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WMT INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO COSTS ARISING FROM AN EVICTION THAT WAS DELAYED OR DISMISSED DUE TO A DEFECTIVE NOTICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE 3 MONTHS PRECEDING THE CLAIM.

You may close your account at any time by emailing support@wapov.dev. We may suspend or terminate your account for non-payment, violation of these Terms, or at our discretion with 30 days' notice.

Upon termination, your access to the service ends. Notice records are retained for 12 months for billing purposes, after which they are deleted.

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in King County, Washington.

We may update these Terms from time to time. Material changes will be communicated by email at least 14 days before they take effect. Continued use of the service after the effective date constitutes your acceptance of the updated Terms.
